# A1 – September 23, 2025 – Stacking Charges

> Amends Charging Procedures

**Definition:** “Stacking charges” is applying multiple counts of similar or overlapping charges to a suspect for a single incident.

## Policy

* Officers may apply **no more than one charge per unique tier** of offense.
* A “unique tier” is the class/level of crime *(e.g., Felony I–IV, Misdemeanor, Infraction)*.
* A suspect may receive **one charge from each felony tier** if supported *(max four felony charges)*.

## Requirements

* Each charge must be supported by evidence and distinct in tier/classification.
* Charges must be read aloud to the suspect at the time of sentencing.

## Prohibited

* Multiple charges of the same tier/class for the same criminal act.
