# A2 – September 23, 2025 – Discretion-Based Policing

> Amends Sentencing Discretion

## Discretion Limitations

* Officers may reduce jail time or fines by a maximum of **30%**.
* Hard cap applies:
  * **90 months** jail time maximum
  * **\$75,000** fines maximum

## Traffic & Infraction Policy

* Officers may not downgrade offenses *(e.g., First Degree Speeding → Third Degree)*.
* The original charge remains. Reduction applies to the **fine only**.
* Reduced fines must be entered as a **custom charge** and documented in the report.

## Evidence Requirement

* Speeding citations require **supporting evidence** *(screenshot / dashcam footage)*.

## Intent

Ensures consistent charge application while allowing limited discretion for cooperation or mitigating factors.
