# A3 - January 6, 2026 - Commercial Vehicle Enforcement

> Commercial vehicle enforcement standards for licensing, cargo, speed, safety, and disposition.

**Definition:**\
“Commercial Vehicle Enforcement” refers to enforcement actions involving **commercial or work-related vehicles** operating for business purposes, including but not limited to **semi-trucks, box trucks, flatbeds, tankers, tow trucks, delivery vehicles, buses, and any vehicle transporting goods or passengers for compensation**.

**Policy:**\
Commercial vehicle enforcement exists to protect public safety due to the increased risk posed by vehicle size, weight, and cargo. Officers may conduct enforcement actions when **Reasonable Suspicion (RS)** or **Probable Cause (PC)** exists. Commercial vehicle status does not reduce constitutional protections but does require **heightened compliance with safety, licensing, and operational standards**.

## Licensing & Authorization Requirements

* Drivers operating vehicles classified as commercial must possess a **valid Commercial Driver’s License (CDL)** when required by vehicle type or load.
* Failure to present a valid CDL when required constitutes a **citable offense** and may result in the vehicle being removed from service.
* Officers may verify:
  * License class validity
  * Driver identity
  * Active suspension or revocation status
* Operating a commercial vehicle without the proper license may result in:
  * Citation
  * Vehicle impound
  * Arrest if tied to additional criminal activity

## Cargo & Manifest Compliance

* Commercial vehicles transporting goods must be able to **articulate the nature of their cargo** upon request.
* When applicable, drivers must present a **cargo manifest, delivery order, or business documentation** identifying:
  * Type of cargo
  * Point of origin
  * Intended destination
* Cargo must be **properly secured** and compliant with roadway safety standards.
* Unsecured, misrepresented, or suspicious cargo may justify:
  * Extended detention
  * Supervisor notification
  * Search based on Probable Cause
* Discovery of illegal cargo (narcotics, weapons, stolen goods) shall follow standard seizure and evidence procedures.

## Commercial Speed Enforcement

Commercial vehicles are subject to **strict speed compliance**. The following limits apply unless otherwise directed by signage or emergency conditions:

* **Dirt & Gravel Roads:** 35 mph (56 km/h)
* **City Streets:** 40 mph (64 km/h)
* **County Roads:** 55 mph (88 km/h)
* **Highways:** 75 mph (120 km/h)

Exceeding these limits may result in:

* Citation
* Escalated enforcement for reckless driving if conditions warrant
* Vehicle removal from service if speed contributes to unsafe operation

## Operational Safety Requirements

* Commercial vehicle stops should prioritize safe pull-off locations whenever possible.
* Officers are encouraged to request an additional unit when stopping large trucks, tow operations, or vehicles carrying hazardous or unknown cargo.
* Officers shall clearly articulate the reason for the stop over the radio and in all documentation.

## Prohibited Practice

* Random or suspicionless commercial vehicle stops (“fishing”) are prohibited.
* Officers shall not conduct cargo searches without consent, Probable Cause, warrant, or exigent circumstances.
* Officers shall not unnecessarily delay lawful business operations without cause.
* Officers shall not order cargo unloaded, seized, or destroyed without proper legal authority and supervisory approval.

## Disposition Guidance

* **Minor or correctable violations** may be addressed with warnings when appropriate.
* **Serious safety violations** (unsafe loads, invalid CDL, severe vehicle defects) may justify tow or impound.
* **Criminal violations** shall be handled under standard arrest and reporting procedures.

## Intent

This amendment establishes clear standards for commercial vehicle enforcement to ensure roadway safety, lawful operation, and consistent officer application while maintaining professionalism and constitutional protections.
