# 7.2 - Misconduct Reporting & Review

> How potential misconduct is reported, documented, and referred for review.

## 7.2.1 - Reporting Concerns

DPS personnel must report suspected serious misconduct under **Section 1.1 — Code of Ethics & Conduct**. Reports should be directed to an appropriate supervisor or authorized command channel. Allegations involving a supervisor should be referred to an uninvolved authority where possible.

## 7.2.2 - Initial Documentation

An allegation or supervisory referral should capture, when available:

* Date, time, and location of the incident.
* Involved and reporting personnel, including callsigns.
* Clear description of the alleged conduct and applicable policy.
* Incident, MDT, body-camera, radio, or other relevant references.
* Witnesses and any immediate safety or operational concerns.

Records must distinguish **reported allegations** from **substantiated findings**. Personnel shall not knowingly falsify, conceal, or destroy relevant records.

## 7.2.3 - Review and Referral

A supervisor or authorized reviewer assesses the available material, identifies applicable policies, and refers potentially serious or conflicted cases to the appropriate Command or Professional Standards authority.

Cases involving force must also comply with the **Full Use of Force Policy**, including its reporting and review requirements. Potential criminal conduct may require separate criminal or judicial review.

## 7.2.4 - Findings

Review outcomes should be documented with a concise factual basis. A reviewer should identify whether an allegation is supported, unsupported, unresolved, or otherwise closed under an approved departmental finding category.

> [!NOTE]
>
> DPS has not provided a controlling formal finding taxonomy, evidentiary standard, or investigation deadline in the former Section 5.4. The categories above describe a documentation approach and must be aligned with any existing Internal Affairs procedures before being used as official classifications.

## 7.2.5 - Confidentiality and Retaliation

Access to disciplinary records is restricted to authorized purposes. Retaliation against good-faith reporters, witnesses, or personnel cooperating with an authorized investigation is prohibited under Section 1.1.
