5.9.1 - Applicability

This page incorporates Amendment A3 (January 6, 2026) governing vehicles operated for commercial/work purposes, including semis, box trucks, flatbeds, tankers, tow trucks, delivery vehicles, buses, and transportation for compensation.

5.9.2 - Lawful Stop & Licensing

Commercial status does not remove constitutional protections. Under the existing A3 rule, officers require reasonable suspicion, probable cause, or other lawful authority for stops. Random suspicionless stops for exploratory enforcement are prohibited. Verify driver identity, relevant CDL/license class, and suspension or revocation where applicable. If the vehicle or cargo requires a CDL, an invalid or missing license may support authorized citation, removal from service, or disposition according to law.

5.9.3 - Cargo & Safety

Officers may request required cargo documentation, including manifests identifying cargo, origin, and destination, when legally applicable. Consider load security and vehicle defects. No cargo search without consent, warrant, probable cause with a valid exception, or other lawful authority. Mere reluctance or unfamiliar freight is not automatic cause to search or extend detention.
  • Use safe pull-off locations.
  • Consider backup for larger or hazardous vehicles.
  • Document the reason for the stop, findings, and disposition.
  • Do not unnecessarily impede lawful business activity.
  • Do not order unloading, seizure, or destruction without legal authority and required approval.

5.9.4 - Historic Commercial Speed Reference

Amendment A3 stated:
These numbers are preserved as A3 historical policy text, but must be reconciled against the current DOJ roadway-specific speed schedule and posted signage. Until approved, apply the controlling current speed regulations; do not use this table to override a posted or revised limit.

5.9.5 - Disposition

Correctable violations may qualify for warnings. Serious safety or licensing offenses may warrant lawful tow/impound. Criminal offenses follow Section 3.7. All seizures and evidence handling follow Section 5.5.
